BAT vs. STT โ€” What's the Difference?

Welcome to TestRight Academy's DOT Breath Alcohol Technician training program. This course qualifies you to conduct federally-regulated alcohol tests under 49 CFR Part 40. We start by covering the two technician roles so you can understand what you're being trained and qualified to do.

โฑ๏ธ The 30-Minute Confirmation Rule

If an STT conducts a screening test with a result of 0.020% BAC or greater, arrangements must already be in place to have the confirmation test administered within 30 minutes of the screening test by a BAT using an approved EBT device.

Plan ahead: If you operate as an STT, you must have a BAT available or on-call who can administer a confirmation test within the 30-minute window. Failing to meet this requirement is a compliance violation.

๐Ÿš” Law Enforcement Exception

Law enforcement officers who have been certified by a state or local government to conduct breath alcohol testing are deemed to be qualified as BATs and are not required to complete the DOT training requirements. However, for a test conducted by such an officer to be accepted under DOT alcohol testing requirements, the officer must have been certified by a state or local government to use the specific ASD or EBT device used for the test.

Portable qualification: BAT and STT qualifications are not location or collection-site specific. Your eligibility follows you anywhere DOT agency regulations require an alcohol test โ€” across employers, clients, and locations.

Pre-Test Procedures

Every DOT alcohol test begins with the same pre-test steps โ€” regardless of the reason for testing. These steps protect the integrity of the test, establish identity, and set the employee's expectations before any device is introduced.

๐Ÿ“‹ Step-by-Step: Before the Test Begins

Greet the Employee and Verify Identity

Request a valid photo ID โ€” driver's license, employer-issued badge, or government-issued photo ID. If no photo ID is available, the DER or employer representative may identify the employee in person. Record the employee's name as shown on their ID.

Do not proceed without positive identification. If you cannot verify identity, contact the DER before beginning the test.

Complete Step 1 of the ATF Before Testing

Fill in the employee's name, SSN or ID number, employer name, DER name and phone number, the reason for the test, and the DOT agency. This must be done before the employee provides a breath sample. See Section 5 (ATF) for full form instructions.

Explain the Testing Process

Tell the employee what is about to happen โ€” that they will be asked to provide a breath sample into the device, and that if the screening result is 0.02 or above, a second confirmation test will be conducted after a 15-minute wait. Keep the explanation factual and professional.

Provide the Employee a Copy of the ATF

Give the employee their copy (Copy 2) of the ATF at the beginning of the test process. They should have it in hand throughout.

Observe the Employee for 15 Minutes Before a Confirmation Test

If you know a confirmation test will be needed (e.g., a return-to-duty or follow-up test), begin your 15-minute observation period before the screening test to save time. During this period, ensure the employee does not eat, drink, belch, or put anything in their mouth, as this can affect the breath test result.

Timing tip: For standard pre-employment or random tests, begin the 15-minute observation period after the screening result โ€” only if the result is 0.02 or above.

Conducting the Screening Test

The screening test is the first breath test administered. It can be conducted using either an approved Alcohol Screening Device (ASD) or an approved EBT. The result of the screening test determines whether the test is complete or a confirmation test is required.

Select and Prepare the Device

Use an approved ASD or EBT device. Ensure the device is functioning properly. If using an EBT, conduct an air blank before the test โ€” the device must display a result of 0.00 on the air blank before proceeding. If the air blank does not read 0.00, do not use the device. Document the malfunction and use an alternate device.

Insert a New Mouthpiece

Open a new, sealed mouthpiece in the employee's presence. Insert it into the device. A new mouthpiece must be used for every test โ€” never reuse a mouthpiece.

Instruct the Employee to Blow

Instruct the employee to blow steadily and forcefully into the mouthpiece for at least 6 seconds, or until the device signals the sample is complete. Demonstrate the technique if needed. Do not touch the mouthpiece after the employee has used it.

Read and Record the Screening Result

Read the result displayed on the device. Record it in Step 2 of the ATF โ€” including the result, the device name, the serial number, and the date and time of the test.

Interpret the Result

Result of 0.00 to 0.019: The test is negative. The collection is complete. Have the employee sign the ATF and distribute copies.

Result of 0.020 or above: You must conduct a confirmation test. Do not tell the employer the result until the confirmation test is complete.

Never report a screening result of 0.02 or above to the employer as a final result. The confirmation test result is the only reportable result for positive tests.

Confirmation Tests & the 15-Minute Rule

When a screening result is 0.020 or above, a confirmation test is required. The confirmation test must be conducted on an approved EBT device โ€” never an ASD โ€” and only after a mandatory 15-minute waiting period.

โฑ๏ธ The 15-Minute Waiting Period

The 15-minute wait before the confirmation test is not optional. Its purpose is to ensure that mouth alcohol from recent eating, drinking, belching, or regurgitation does not produce a falsely elevated result.

  • 1Start the 15-minute timer immediately after the screening result of 0.020 or above is recorded.
  • 2During the 15-minute period, observe the employee. They must not eat, drink, smoke, belch, or put anything in their mouth.
  • 3If the employee belches or regurgitates during the 15-minute period, restart the timer. You may allow them up to 3 hours total to complete the waiting period.
  • 4If the employee is unable to avoid these activities for 15 minutes and the 3-hour window has passed, document the situation and note it on the ATF. Proceed with the confirmation test and note the circumstances.
You may conduct other collections during the 15-minute wait โ€” but you must continuously monitor the employee to ensure they do not eat, drink, or belch.

Use Only an Approved EBT Device

Confirmation tests must be conducted on an approved Evidential Breath Testing (EBT) device. An ASD cannot be used for confirmation testing, even if the screening test was conducted on an EBT.

Conduct a New Air Blank

Before the confirmation test, conduct a new air blank on the EBT. The device must display 0.00. If it does not, stop โ€” document the malfunction and use a different device.

Insert a New Mouthpiece

Use a fresh, sealed mouthpiece for the confirmation test โ€” even if the same device was used for the screening test.

Have the Employee Blow

Same procedure as the screening test โ€” steady, forceful breath for at least 6 seconds or until the device signals completion.

Read and Record the Confirmation Result

Record the result in Step 3 of the ATF, along with the device serial number and the date and time of the confirmation test. The confirmation test result is the official, reportable result.

Interpret and Report the Confirmation Result

0.000 โ€“ 0.019: Report as negative โ€” the confirmation result overrides the screening result.

0.020 โ€“ 0.039: Alcohol confirmed. Notify the DER. Employer takes action per agency regulations.

0.040 and above: DOT action level. Notify the DER immediately. Employee must be immediately removed from safety-sensitive duties.

The Alcohol Testing Form (ATF)

The Alcohol Testing Form (ATF) is the official federal form used to document every DOT alcohol test. It must be completed accurately and completely โ€” errors on the ATF can result in a cancelled test or compliance violation.

Step 2 โ€” Screening Test Result (BAT completes after screening test)

Enter: the screening result, device name and serial number, the date and time of the screening test. Check the appropriate result box. If the result is 0.020 or above, do not distribute copies yet โ€” proceed to the confirmation test.

Step 3 โ€” Confirmation Test Result (BAT completes after confirmation test, if applicable)

Enter: the confirmation result, device name and serial number, and the date and time of the confirmation test. Record the air blank result. This step is only completed when a confirmation test was conducted.

Step 4 โ€” BAT Certification (BAT signs after test is complete)

The BAT certifies that the test was conducted in accordance with 49 CFR Part 40. Sign, print your name, and record the date. Your signature means the test was conducted correctly โ€” do not sign if there were procedural errors you cannot correct.

Step 5 โ€” Employee Signature

Have the employee sign and date Step 5. The employee is certifying that the test was performed as described. If the employee refuses to sign โ€” note it in the remarks section and proceed. A refusal to sign is NOT a refusal to test.

โš ๏ธ Common ATF Errors to Avoid

  • โœ— Leaving the reason for test blank
  • โœ— Recording the screening result in the confirmation result field (or vice versa)
  • โœ— Omitting the device serial number
  • โœ— Failing to record the date and time of each test
  • โœ— Signing Step 4 before the test is fully complete
  • โœ— Giving the employer Copy 1 before the confirmation test is done

Problem Scenarios & Refusals

Not every test goes by the book. As a BAT or STT, you must know how to handle refusals, incomplete tests, shy lung situations, and device malfunctions โ€” and document each one correctly.

๐Ÿšซ Refusal to Test

A refusal to test carries the same consequences as a positive test result under DOT regulations. The following actions constitute a refusal:

  • โœ—Employee fails to appear for the test within a reasonable time after being directed to report
  • โœ—Employee refuses to complete and sign Step 5 of the ATF (this IS a refusal โ€” different from refusing to sign after the test)
  • โœ—Employee fails to provide an adequate amount of breath โ€” and a medical evaluation does not find a legitimate reason
  • โœ—Employee leaves the testing site before the test is complete
  • โœ—Employee behaves in a confrontational or disruptive manner that prevents the test from being conducted
  • โœ—Employee admits to the BAT or STT that they consumed alcohol within 8 hours before the test (post-accident) or within 4 hours (other regulated tests)
When a refusal occurs: Stop the test. Document it thoroughly in the remarks section of the ATF. Notify the DER immediately. Complete the ATF with the refusal noted and distribute copies.

๐Ÿ’จ Shy Lung (Inability to Provide Adequate Breath)

Shy lung occurs when an employee cannot or will not provide an adequate breath sample. Follow these steps:

Make a Second Attempt

Encourage the employee to try again. Most employees can provide an adequate breath sample when coached on proper technique. Allow up to 2 attempts.

Document the Incomplete Test

If the employee still cannot provide an adequate sample, note it on the ATF in the remarks section. Record the time and the number of attempts. Do not report a result.

Notify the DER

Notify the DER of the incomplete test. The DER must direct the employee to a licensed physician for evaluation of whether a medical condition could explain the inability to provide a breath sample. If no medical reason is found, it is treated as a refusal.

๐Ÿ”ง Device Malfunction

If your device malfunctions during a test:

  • 1Stop the test. Do not record a result from a malfunctioning device.
  • 2Document the malfunction in the remarks section of the ATF โ€” include what the device displayed and when it occurred.
  • 3If another approved device is available, use it to complete the test. Begin from the beginning โ€” new air blank, new mouthpiece, new test.
  • 4If no alternate device is available, note this on the ATF. Notify the DER. Do not report a result. The test may need to be rescheduled.
Air blank failure counts as a malfunction. If the air blank does not read 0.00 before a test, the device is not functioning properly โ€” do not use it.

For any test that cannot be completed โ€” whether due to refusal, shy lung, or malfunction โ€” record the following on the ATF:

  • โœ“ The reason the test was not completed
  • โœ“ The time of each attempt
  • โœ“ What the employee said or did
  • โœ“ The name and number of the DER you notified
  • โœ“ The time you notified the DER

Device Operation & Calibration

As a BAT or STT, you must be proficient in the operation of the specific device you use. This section covers what you need to know about ASD and EBT devices, air blanks, external calibration checks, and handling error messages.

  • Used for screening and confirmation tests
  • Breath-based only
  • Requires an air blank before every test
  • Prints a result record automatically
  • Serial number and result are recorded on the ATF
  • Required for all confirmation tests

๐Ÿ’จ Air Blanks โ€” What They Are and When to Run Them

An air blank is a test of the EBT device using ambient air โ€” no breath from any person. It verifies that the device is reading clean air as 0.00 and is not contaminated by residual alcohol from a prior test.

  • 1Before every screening test on an EBT โ€” the device must read 0.00
  • 2Before every confirmation test on an EBT โ€” run a new air blank, even if the EBT was used for the screening test minutes earlier
  • 3After each employee test โ€” some EBT devices run air blanks automatically; know whether yours does
If the air blank reads anything other than 0.00, do not use the device. Document the malfunction and use an alternate EBT.

๐Ÿ“ External Calibration Checks

EBT devices must be externally calibrated on a regular schedule to ensure accuracy. As a BAT, you need to know:

  • โœ“ When a calibration check is required โ€” follow the manufacturer's schedule and DOT requirements for your specific device
  • โœ“ Who performs calibration โ€” typically a qualified technician or the device manufacturer's service program, not the BAT
  • โœ“ What to do if calibration is overdue โ€” do not use the device until it has been calibrated
  • โœ“ Where to find the calibration log โ€” you must be able to confirm the device's calibration status if asked by an inspector or employer

โš ๏ธ Error Messages and Device Malfunctions

You must know how to respond to your device's error messages. While specific codes vary by manufacturer, general responses include:

  • ๐Ÿ”ดInsufficient breath sample โ€” instruct the employee to try again; if it persists, begin shy lung procedures
  • ๐Ÿ”ดAir blank failure โ€” stop the test; do not use the device; document and switch to an alternate
  • ๐Ÿ”ดDevice out of calibration โ€” stop all testing; do not use the device; contact service
  • ๐Ÿ”ดMemory full or printing error โ€” document the issue; if the device cannot print a result record, note it on the ATF and continue

Proficiency Demonstration

Your proficiency demonstration is conducted live with your TestRight Academy instructor via Zoom. Your instructor observes every mock test in real time, provides guidance between attempts, and signs your written proficiency attestation upon successful completion.

Consecutive means consecutive. If an error occurs during the sequence, the count resets. Your TestRight instructor will guide you and clarify any questions between attempts.

Testing Site Requirements & Security

Every DOT alcohol test must be conducted at an appropriate testing location. This section covers what makes a site acceptable, how to maintain privacy and integrity, and your responsibilities as the BAT or STT on-site โ€” per ยง40.215, ยง40.221, and ยง40.223.

๐Ÿ“‹ DER Information โ€” What You Must Have Before Testing

Per ยง40.215, before you conduct an alcohol test you must have the following employer (DER) information available:

  • 1The employer's name and address โ€” entered in Step 1 of the ATF
  • 2The DER's name and telephone number โ€” you must be able to contact the DER immediately if a problem arises
  • 3The reason for the test โ€” pre-employment, random, post-accident, reasonable suspicion, return-to-duty, or follow-up
  • 4The DOT agency โ€” FMCSA, FAA, FRA, FTA, PHMSA, or USCG
Never begin a test without the DER's contact information. If a refusal, shy lung, or any problem occurs, you must be able to notify the DER immediately.

๐Ÿข What Makes a Testing Site Acceptable (ยง40.221)

A testing location is acceptable for DOT alcohol testing only if it meets all of the following requirements:

  • โœ“ Prevents unauthorized access โ€” only you, the employee, and any authorized observer may be present during the test
  • โœ“ Allows a private conversation between you and the employee without being overheard
  • โœ“ Has a suitable flat surface for completing the ATF
  • โœ“ Has adequate lighting for you to properly read and record results and complete the ATF
  • โœ“ Is free of items that could interfere with the testing process
Dedicated collection rooms are not required. A suitable private area in an office, clinic, or mobile testing unit can qualify as long as these conditions are met during the test.

๐Ÿ”’ Protecting Privacy and Integrity โ€” Your Responsibilities (ยง40.223)

As the BAT or STT, you are personally responsible for maintaining the privacy of the employee and the integrity of the test throughout the entire process.

Keep Unauthorized Persons Out

Only you and the employee should be present during the test. No supervisors, coworkers, or bystanders. If someone attempts to enter the testing area, politely but firmly direct them to leave. Document any intrusion in the ATF remarks.

Conduct the Test Without Interruption

Once the test has begun, do not leave the area or allow interruptions. If an interruption occurs that compromises the integrity of the test, document it, stop the test, and contact the DER.

Keep Results Confidential

Alcohol test results are confidential. You may report results only to: the DER, the MRO (if applicable), the C/TPA (if applicable), and DOT agency representatives. You may not report results to supervisors, coworkers, or other unauthorized persons.

Maintain Control of the ATF

Keep the ATF in your possession throughout the test. Do not allow the employee or any other person to handle or alter the form. Once completed, distribute copies only to authorized recipients as required by ยง40.225.

Treat the Employee With Professionalism

Regardless of the reason for the test, treat the employee respectfully and professionally. Your role is to conduct the test correctly โ€” not to judge or comment on the circumstances. Never discuss the test result with the employee beyond what is required (e.g., telling them the test is complete or that a confirmation test is needed).

๐Ÿšซ What You Must NOT Do During Testing

  • โœ— Allow anyone other than you and the employee to be present without authorization
  • โœ— Leave the testing area before the test is complete
  • โœ— Conduct a test in a location that does not provide adequate privacy
  • โœ— Report results to unauthorized persons
  • โœ— Allow the employee to handle the ATF or the device
  • โœ— Conduct any part of the test in a location where it could be overheard by others

Fatal Flaws, Correctable Flaws & Cancelled Tests

Not every completed test is a valid test. Some errors are so serious the test must be cancelled entirely โ€” these are called fatal flaws. Others can be fixed with a correction. You must be able to identify both and know exactly what to do. Per ยง40.267, ยง40.269, ยง40.271, and ยง40.273.

๐Ÿšจ Fatal Flaws โ€” Tests That Must Be Cancelled (ยง40.267)

A fatal flaw is an error that makes the test result invalid and uncorrectable. If any of the following apply, the test result must be cancelled โ€” it cannot be reported or used for any purpose:

  • โœ—The test was conducted with an unapproved device โ€” a device not on the NHTSA conforming products list
  • โœ—Two separate testing devices were not used for the screening and confirmation tests when required (different mouthpieces do not count โ€” a different device is required when using a non-printing ASD for the screening test)
  • โœ—The test was not conducted by a qualified BAT or STT โ€” or the STT attempted to conduct a confirmation test (which only a BAT can do)
  • โœ—The screening test result was 0.020 or above and no confirmation test was conducted within the required timeframe
  • โœ—The required 15-minute waiting period before the confirmation test was not observed
A fatal flaw means the test is cancelled. You must note the reason on the ATF (in the remarks section), notify the DER, and instruct the DER that they may direct the employee to a new test if required.

๐Ÿ”ง Correctable Flaws โ€” Errors You Can Fix (ยง40.269)

A correctable flaw is an error that does not automatically invalidate the test โ€” but it must be corrected with a specific written statement before the result can be reported. These errors are correctable within a limited timeframe:

  • โš ๏ธThe BAT omitted a required entry on the ATF โ€” such as the device serial number, test date/time, or result (can be corrected if the omission is discovered in time)
  • โš ๏ธThe employee did not sign the ATF โ€” the BAT must note this in the remarks section; a refusal to sign is not a refusal to test
  • โš ๏ธThe BAT failed to note the time of the screening result when it is required for determining the 15-minute waiting period
Correctable flaws do not cancel the test โ€” but they must be corrected before the result is reported. If correction is not possible, the test must be cancelled.

โœ๏ธ How to Correct a Correctable Flaw (ยง40.271)

To correct a correctable flaw, you must provide a written statement โ€” signed and dated โ€” explaining:

  • โœ“ What the error was
  • โœ“ The correct information that was omitted or entered incorrectly
  • โœ“ Why the error occurred (if known)

This statement must be attached to the ATF and provided to the employer (DER) along with the corrected form. The statement must be prepared as soon as the error is discovered โ€” you cannot wait until an audit or inspection to fix it.

โŒ Cancelled Tests โ€” What They Mean (ยง40.273)

A cancelled test โ€” whether due to a fatal flaw or an uncorrectable flaw โ€” is treated as follows:

  • 1A cancelled test is not a positive test. It cannot be reported as a violation. The employee's record does not reflect a positive result.
  • 2A cancelled test is not a negative test either. It cannot be used to clear the employee to perform safety-sensitive functions. If the employer needed a negative result (e.g., for return-to-duty), another test must be conducted.
  • 3The DER must be notified. When you cancel a test, you must immediately notify the DER of the cancellation, the reason, and that a new test may be required.
  • 4Document everything. Record the reason for cancellation in the ATF remarks, note the time you notified the DER, and retain your copy of the ATF per normal retention rules.

Your refresher training must be completed within 5 years of your initial qualification. If it lapses, you cannot conduct DOT alcohol tests until refresher training โ€” including a new proficiency demonstration โ€” is complete.

Receive Your Qualification Documents
